Consumer protection and market practices

Over the years, a number of laws have been enacted aimed primarily at ensuring adequate consumer protection. Partly under the impetus of European legislation, special regulations have been drawn up to protect consumers, for example in the areas of purchase and sale, (comparative) advertising, agreements concluded remotely or outside the company, misleading information, etc. It goes without saying that companies have to anticipate the latest trends and focus their energies on finding solutions that really work.

Furthermore, this approach to consumer protection, particularly in the Belgian context, has also served as a model that determines the regulations that companies must comply with when they interact. These regulations have recently taken on greater importance due to the introduction of the law of 4 April 2019 amending the Code of Economic Law on abuse of economic dependence, abusive clauses and unfair market practices between companies.

  • Within this context, GSJ’s teams have extensive experience in many areas:
  • drafting general terms and conditions
  • screening agreements for abusive clauses
  • offering advice on the design of webshops
  • reviewing planned advertising campaigns
  • onducting injunctive relief proceedings to bring an end to unfair market practices
